Introduction Juvenile crime has been a serious concern for the society in the recent times. The increasing rate of crime among juveniles has brought the focus on the need to frame tough and concrete laws to control the menace of juvenile crime. In one such argument it is mentioned that the lack of relevant laws to prevent juvenile crime has lead to the spurt in crime rate. A report states “increasing violence among teenagers and other youths appears to have contributed to a nationwide crime spike” (NBS, 2010). The dramatic rise of juvenile crime has made it necessary for lawmakers and general society to deliberate upon the manner in which this rising menace needs to be tackled. The clearest way is to have laws which remove the immunity that law provides to juvenile criminals. Juveniles charged with atrocious crime should be charged and tried with laws similar to adults. History and status of the issue The history of juvenile crime is not a recent one. But, in the last few decades the issue has gathered pace. It has been pointed out that there has been a “disturbing rise of juvenile crime in U.S. cities since 1960, a rise made more terrible by an unprecedented increase in violent crimes such as rape and murder.” (Sukhia, 2005) The issue has a lot of relevance in the present scenario. “In 2008, an estimated 60% of children in the United States were exposed to violence, crime, or abuse in their homes, schools, and communities within the past year.” (Crime Solutions) This trend has been carried forward in the year 2010, where it was seen that “juvenile offenders were known to be involved in 8% of all homicides in the United States” (Crime Solutions). In a disturbing turn of events it has been analyzed that one third of Americans teenagers and young adults are likely to have been arrested once before the age of 23. (Duell, 2011) First problem: Bullying among Adolescents Among the most common problem, associated with juvenile crime, is the issue of bullying. Bullying are negative acts among adolescents which might have physical, verbal or psychological actions. These acts create a deep impact on minds of adolescents and might precipitate in heinous crimes like “shootings at Columbine High School in Littleton, in 1999 and Santana High School in Santee, in early 2001” (Ericson) A study of National Institute of Child Health and Human Development (NICHD) has revealed that bullying which is the commonest problem of juvenile crime, impacts adolescents in a number of manners. The primary effect of this form of juvenile crime is that, it creates depression in the minds of victims which leads to anti-social behavior and suicide. “Bullying behavior has been linked to other forms of antisocial behavior, such as vandalism, shoplifting, skipping and dropping out of school, fighting, and the use of drugs and alcohol.” (Ericson). Children who have been bullies are more likely to be convicted as criminals in adulthood. The problem of bullying requires attention in order curb and control the rising level of crime among adolescents. (Ericson) Second problem: Media Violence Media violence has been a big problem area that has increased the level of juvenile crime. It has been referred that media violence has led adolescents’ impressionable minds to crime. In a Federal Trade Commission inquiry into the “entertainment industry’s marketing of violent movies, video games, and music, called for stricter enforcement of motion picture industry’s rating system for violent and sexually explicit films.” (Binder, Geis & Bruce, 2001) Media violence has a deep impact and is a serious problem area for the issue of juvenile crime which needs to monitored and controlled. Increasingly media violence creates affinity for violence in the minds of impressionable adolescents. Third Problem: Treating juveniles similar to adults The issue of need to treat juveniles as adult criminals has divided opinions. The supporters of softer treatment for juveniles argue that adolescents should not be treated like adults as they are fundamentally different from adults. According to these set of people, juveniles have youthful spirit which makes them easy target for change in their attitude and behavior. So, instead of sentencing them like adults they should be sent away to correctional homes. They also argue that these juveniles are likely to have been influenced by peers and so should be protected from incrimination under a legal system created for adults. This benevolent assessment carries along some serious mistakes. (Clear, Cole & Reisig, 2010) The views of people who call for softer treatment of juveniles, fails to take into account a number of parameters. Firstly, strict legal system acts as a strong deterrence for juvenile crime. It is seen that juveniles are likely to commit grave crimes like rape and murder as they are under the protection of softer laws and are unlikely to be tried under stricter adult laws. This sense of protection from law fuels criminal tendencies among the juveniles and should be curbed. Secondly, when a juvenile is imprisoned he also gets the proper monitoring system wherein he can be put under correctional programs. Thirdly, it also stops further crime among juvenile as they are rendered incapacitated when put behind bars. So, it is necessary to treat juveniles as adults and have equal standards of punishment for grave crimes committed by them. (Council on Crime in America, 2004) Conclusion The increasing rate of criminal activities among juveniles has sharply divided society into those proposing softer treatment for juveniles while the others call for strict punishments which are equal to adult criminals. It is seen juvenile crime emanates from a number of problems like bullying and media violence. To control this growing menace it is required that a strong deterrent is proposed.
